Malicious prosecution occurs when someone initiates or continues a criminal proceeding against you without probable cause and with malice (improper purpose), and the proceeding ends in your favor. It's a violation of your Fourth Amendment rights.

You must prove: (1) a criminal proceeding was initiated against you, (2) the proceeding ended in your favor (dismissal, acquittal), (3) there was no probable cause for the charges, and (4) the proceeding was initiated with malice or improper purpose.

Prosecutors generally have absolute immunity for their prosecutorial decisions. However, police officers and others involved in fabricating evidence or initiating baseless charges may be liable. Some extreme prosecutorial misconduct may also be actionable.

The statute of limitations typically begins when the criminal proceeding ends in your favor. In New York, Section 1983 claims have a 3-year statute of limitations. Consult an attorney promptly after charges are dismissed or you're acquitted.
